Miriam Rozen

December 11, 2009

Belton, Texas, solo John Galligan, who represents Maj. Nidal Malik Hasan, the Army psychiatrist who allegedly went on a shooting spree at Fort Hood on Nov. 5, says he has learned the precise terms of his client's pretrial confinement.

Hasan is paralyzed from the chest down and bedridden in a military hospital in San Antonio, says Galligan. He says the U.S. Army command has imposed rules that allow for a closed-circuit television camera in Hasan's room for Hasan's and others' safety;... More...

Craigslist, eBay Face Off in Closely Watched Trial
Shannon P. Duffy
The Legal Intelligencer
December 08, 2009

In a trial that has been billed as the "Clash of the Digital Titans," a judge on the Delaware Chancery Court began hearing testimony Monday in a corporate governance battle between eBay, the popular online auction site, and Craigslist, the online classified advertising site.

In the suit, eBay claims that when it purchased a minority ownership stake in Craigslist in 2004, it was promised a seat on the Craigslist board and expected that the companies would begin cooperating with the goal of one day merging.

Instead, eBay claims, Craigslist's top executives never truly cooperated with eBay and instead took secret steps to dilute eBay's stake and deny it a seat on the Craigslist board. More...

Vaccine Cases Spark Interest -- and an Unusual Move by Plaintiffs
Alyson M. Palmer
Fulton County Daily Report
December 02, 2009

As attention to vaccine liability heats up, the justices of the U.S. Supreme Court are weighing whether to hear a case from Georgia in which the state high court has said vaccine makers could be held liable for a boy's neurological problems.

In an unusual turn, the Georgia plaintiffs have dropped their suit for now, meaning that a similar case from Pennsylvania could be the vehicle by which the nation's highest court decides the question.

At issue is whether a 1986 federal statute that set up a special compensation system for vaccine injuries bars plaintiffs from suing vaccine makers in state courts for design defects. The so-called federal vaccine court is supposed to work under a no-fault system in which claimants who can show they were injured by vaccines can recover from a pool of money maintained through a vaccine tax. The system caps recovery amounts and has been criticized as unfair to claimants. More...

N.Y. Judge Censured for Helping Arrest Motorist
Valerie Bauman
The Associated Press
November 30, 2009

A village justice in New York was censured for following a motorist for more than a mile, pulling the man over by flashing his high beams and using a badge to persuade the driver to turn himself in to police to face two traffic citations.

The state Commission on Judicial Conduct announced Wednesday that it was censuring Hudson Falls Village Justice Michael Feeder.

Feeder told the commission that he saw the driver fail to yield to a pedestrian in a crosswalk. Feeder was in contact with police as he followed the other driver, and presented a badge bearing the words "Town Justice" after pulling the man over. More...
